Intellectual property and Technology Transfer: Challenges

Hello delegates! It's Brendan, and here is your first topical blog post. These blog posts will be formatted with key points, followed by one or two questions for thought at the end.

International property rights and technology transfer is especially contentious when it comes to developing nations. Because of their limited funds, developing nations often protest against the lack of the slow implementation of the World Intellectual Property Organization's Development Agenda.

There is also disagreement between the developed and developing world regarding the direct or indirect transfer of technology. Developing countries prefer a direct transfer of technology rather than having a third party or company regulate. According to a questionnaire distributed among regional universities, companies often do not spread technology evenly across a country.

With the question of how to best distribute technology comes the question of what should be prioritized in distribution. Three major areas that developed nations would appreciate innovative technology in are the health sector, the agricultural sector, and the energy sector.

Finally, it is important to understand the role of local patent organizations such as the African Intellectual Property Organization. Vague roles of these organizations often lead to contentious agreements or clash regarding WIPO agreements or patent rights.

Questions:

What are the major points of contention between local ideas of property rights and international jurisdiction? Are most of the challenges connected with international regulation, or lack of clarity among regional patent law?

Cheers,
Brendan
